Plaintiffs bring suit against the University of Washington for breach of contract on behalf of themselves and a putative class of similarly situated individuals. Plaintiffs maintain, among other claims, that the University breached their retirement contracts with participating faculty when they failed to provide the total amount of employer matching contributions owed under the terms of the plan. This class action was brought on behalf of part-time Washington community and technical college faculty who did not receive their pro-rated amount of sick leave provided under state statute. The Superior Court recently held that class members are employed on written contracts and the statute of limitations allows class members to recoup sick leave from 2006 forward. This class action was brought on behalf of Washington community and technical college faculty and staff improperly denied retirement benefits due under the State Board Retirement Plan.
Recently, the King County Superior Court found the State liable for breach of contract, ruling that the State could not rely on "break in service" language added to the plan in 2016 to restrict participant eligibility for the supplemental retirement plan. Other issues were added in an amended complaint.
